These Terms govern use of the Taysend SMS gateway at taysend.com. Last updated 27 August 2026. Also read the Privacy Policy and the FAQ.
1. Parties and the service
These Terms and Conditions (“Terms”) govern access to and use of Taysend, the SMS gateway, console, and APIs published at taysend.com and related subdomains (the “Service”).
The Service is operated by Taysend (“we”, “us”). “You” means the individual or organisation that registers an account or uses an API key. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation.
By creating an account, generating an API key, or sending traffic, you agree to these Terms and to the Privacy Policy at /privacy. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must provide a real email address, keep credentials secret, and tell us promptly if a key or password is compromised. API keys are shown once. You are responsible for all traffic sent with your keys.
Customer accounts use the console. You must not attempt to escalate privileges or access another organisation’s data.
We may suspend or close an account that is inactive, abusive, unpaid, or that presents risk to networks, end users, or the Service.
3. Environments: TEST and LIVE
TEST keys and the simulated provider exist so you can prove the pipeline without spending GHS or reaching a live handset. TEST traffic must not be treated as production delivery.
LIVE traffic is billed, uses approved sender IDs, and is handed to wholesale partners. You must not use TEST behaviour as a warranty of LIVE outcomes.
4. Prepaid wallet and charges
Unless a written contract says otherwise, the Service is prepaid in Ghanaian Cedi (GHS). We reserve estimated cost before send and settle after billed units are known.
A billed unit depends on destination, encoding, and how many segments the body produces. Unicode / UCS-2 bodies cost more units than GSM-7.
If the wallet cannot cover the reservation, the send is rejected (including INSUFFICIENT_BALANCE). We do not extend unofficial credit.
Fees already reserved or settled for accepted submits are not refunded solely because a later DLR is FAILED, EXPIRED, or REJECTED. Network outcomes are outside our sole control.
Taxes, if applicable under Ghana law, are in addition to the listed unit price unless a contract states they are included.
5. Sender IDs and content
You must only send from sender IDs you are authorised to use. Ghana LIVE alphanumeric sender IDs require our approval and must match names approved on the wholesale route.
You are solely responsible for message content, consent, and any licence to contact the destination. You must not send unlawful, fraudulent, harassing, or unsolicited marketing SMS, or traffic that evades network filters.
OTP and transactional use must match what you told the recipient. Marketing traffic must follow applicable Ghana electronic communications and data-protection rules, including a lawful basis to contact the number.
6. Delivery, routing, and reports
An HTTP success or “accepted” / “queued” / “submitted” state means we received and processed the request. It is not confirmation that the handset received the SMS.
Delivery reports (DLRs) are the source of terminal status. We record them when partners send them. Delay, loss, or contradiction of a DLR can occur on the destination network.
We may change the wholesale path for a destination to keep the Service available. We do not promise a named upstream partner in these Terms.
Idempotency keys exist so retries do not double-send. Replaying the same key and body returns the original result. Changing the body with the same key is unsafe.
7. Acceptable use and prohibited traffic
You must not use the Service to transmit malware, phishing, scam investment or lottery content, unlawful adult content involving minors, or anything that violates Ghana criminal or communications law.
You must not probe, overload, or bypass rate limits, authentication, or sender-ID controls. You must not resell the Service as if you were Taysend without a written reseller agreement.
We may block numbers, sender IDs, or entire organisations when we detect abuse, regulator demand, or partner instruction.
8. APIs, uptime, and changes
We aim for high availability and publish status at /status. Planned maintenance and incidents may interrupt send. Credits, if any, are only those we write in a contract or incident notice.
We may add, change, or retire API fields with notice on the developers site when the change is breaking. Security fixes may ship without delay.
9. Intellectual property
Taysend, the wordmark, and the Service software remain ours or our licensors’. You receive a limited, revocable licence to use the Service for your internal messaging. You do not receive a licence to copy our docs wholesale as your own product.
You keep ownership of the message bodies and contact lists you submit. You grant us a licence to process them only to provide, secure, bill, and improve the Service, and to meet legal duties.
10. Confidentiality and security
API keys, session cookies, and wallet balances are confidential. Store keys in a secret manager. Do not commit them to git or paste them in public tickets.
We use industry-standard controls (including hashed passwords and encrypted provider credentials). No method is perfect. You must still protect endpoints that receive webhooks.
11. Warranties and liability
The Service is provided on an “as is” and “as available” basis. We do not warrant uninterrupted send, a specific latency, or that every DLR will arrive.
To the fullest extent allowed by Ghana law, we are not liable for indirect, incidental, special, or consequential loss, lost profits, or lost data. Our aggregate liability for a claim arising from the Service is limited to the GHS you paid us for the Service in the three months before the claim.
Nothing in these Terms excludes liability that Ghana law does not allow to be excluded, including fraud or death or personal injury caused by negligence where that rule applies.
12. Indemnity
You will indemnify Taysend against claims, fines, and costs arising from your content, your lack of consent, your misuse of sender IDs, or your breach of these Terms.
13. Suspension and termination
You may stop using the Service and request account closure by writing to bds.inc0101@gmail.com. Prepaid balances may be refunded only if a written policy or contract says so and no abuse is outstanding.
We may suspend immediately for non-payment, abuse, legal demand, or risk to the platform. After closure we retain records as required by law and the Privacy Policy.
14. Changes to these Terms
We may update these Terms. The “Last updated” date at the top of this page will change. Material changes will be announced in the console or by email to the address on the account. Continued use after the effective date is acceptance.
15. Law and disputes
These Terms are governed by the laws of the Republic of Ghana. The courts of Ghana have exclusive jurisdiction, except that we may seek injunctive relief in any forum to protect the Service or third-party networks.
